This Week in State Tax (TWIST) is produced weekly by KPMG’s State and Local Tax practice to help keep you up to date on the latest in state and local tax. This week, June 29, 2009, join KPMG's State and Local Tax professional Sarah McGahan, Manager, Washington National Tax, as she covers the following topics:

  • California – Democrats in California have proposed a plan that would eliminate certain tax benefits.
  • New Jersey – The New Jersey Tax Court has recently addressed a taxpayer’s contention that it should not be barred from receiving a sales and use tax refund because its claims were not filed within the four-year statute of limitations period.  
  • North Carolina – A North Carolina conference committee is currently working on Senate Bill 202, which, if adopted, would make a number of significant changes to North Carolina’s tax laws.  
  • Oregon – In Oregon, several bills have recently been passed that enact numerous corporate tax changes.  
  • U.S. Supreme Court – On June 22, 2009, the U.S. Supreme Court declined to review two Massachusetts cases holding that the Commerce Clause “substantial nexus” requirement does not require that a taxpayer have a physical presence in the Commonwealth.
